On September 25, 2020, President Donald Trump signed an Executive Order on Protecting Vulnerable Newborn and Infant Children.
While federal law already offers some protection for born-alive infants, the President’s order contains additional directions for the Secretary of Health and Human Services in regard to this important issue. The order directs the Secretary to ensure that persons responsible for federally-funded programs are aware of their obligations in regard to born-alive infants. The order further requires the Secretary to investigate and enforce legal protections for born-alive infants. Furthermore, the order makes clear that a child’s disability is not a valid reason to withhold treatment. Finally, the order makes it a priority to fund research regarding born-alive infants.
“‘HHS’s mission is to protect the health and well-being of all Americans, and that means all Americans—including infants born prematurely and infants with disabilities,’ said HHS Secretary Alex Azar. ‘The President’s Executive Order is another step by the most pro-life President in American history and ensures that we provide the same protections for innocent infants who are born premature or with disabilities that we provide for every other American.’”
